Failure to Check Training Records Leads to Death

Building Research Establishment (BRE) and the employer of a forklift truck driver who died in an accident at Hangar no.1 at the former RAF Cardington, Bedfordshire, in May 2003 have both been fined in connection with lapses that permitted the accident to occur. Employer Welwood Roofing Services Ltd of Corby was fined £50,000 with costs of £25,000 for a breach of the HSW Act, BRE of Watford was fined £17,500 with £12,000 costs after pleading guilty to breaching r.9(1) of the Provision and Use of Work Equipment Regulations1998 for supplying the deceased's truck, for which he was not adequately trained.

An HSE Inspector explained:-

"I hope this tragic accident makes it clear to employers that they need to take positive action to manage risks, particularly where the work involves using forklift trucks. The deceased's death could have been avoided had the companies involved carried out checks to confirm whether or not he knew of the dangers of forklift trucks and how to drive them safely."
