Please note that there are now new rules that have come into play in respect of ACAS early conciliation.
So, what does that mean for you and your company?
It means that if any employee wants to take you and your company to Employment Tribunal, they must now engage in a standard 6-week ACAS early conciliation process prior to doing so. Previously this has been set at 4 weeks.
Of course, if both parties indicate at the outset that they don’t want to conciliate the matter, then ACAS can issue a certificate earlier that above, but both parties would need to agree this however.
